These Terms of Service ("Terms") govern your access to and use of the Goji platform ("Service"), operated by Goji Pet, LLC ("Goji," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is a cloud-based pet care business management platform that enables dog walking businesses ("Business Users") to manage appointments, customers, staff, and payments. Pet owners ("End Users") may access the Service through a Business User's portal to schedule appointments and manage their accounts.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We do not knowingly collect data from individuals under 18.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized access to your account.
You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
Goji offers a free tier and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) and renew automatically at the end of each billing period unless cancelled.
Free Trial. If you start a free trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before the trial expires. We will notify you before the trial ends.
Auto-Renewal. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
Price Changes.We may change subscription pricing with at least 30 days' prior notice. Continued use after a price change constitutes acceptance of the new pricing.
Refunds. Subscription fees are non-refundable except as required by applicable law. You will not receive a pro-rated refund for any unused portion of a billing period upon cancellation.
Goji uses Stripe to process payments between Business Users and their customers. By using the payment features of the Service, you agree to Stripe's Connected Account Agreement and Terms of Service.
Goji is not a party to transactions between Business Users and their customers. Business Users are solely responsible for the services they provide, their pricing, and compliance with applicable laws. Goji charges a platform fee on transactions processed through the Service.
Business Users may configure cancellation fee policies for their services. When an End User cancels an appointment within the configured cancellation window, the applicable fee will be charged automatically. Cancellation policies are set by the Business User, not by Goji.
You retain ownership of all content you upload to the Service, including but not limited to pet photographs, walk media, documents, and profile information ("User Content").
By uploading User Content, you grant Goji a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and process your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete the content or your account, except for content shared with other users (which remains accessible to them).
You represent that you have the right to upload any content you provide and that it does not violate any third party's rights.

The Service, including its design, code, features, and documentation, is owned by Goji and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service.
"Goji" and associated logos are trademarks of Goji Pet, LLC. You may not use our trademarks without prior written consent.
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
Business Users are responsible for ensuring they have appropriate legal basis to collect and process their customers' personal information through the Service. Goji acts as a data processor on behalf of Business Users with respect to End User data.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service is provided "as is" without any uptime guarantees or service level agreements. We may perform maintenance, updates, or modifications that temporarily affect availability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOJI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GOJI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
GOJI IS NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF BUSINESS USERS, THEIR STAFF, OR ANY SERVICES THEY PROVIDE TO END USERS THROUGH THE PLATFORM.
You agree to indemnify, defend, and hold harmless Goji, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) the services you provide to your customers through the platform.
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
Class Action Waiver. You agree that disputes will be resolved on an individual basis and waive any right to participate in a class action, collective action, or representative proceeding.
Opt-Out. You may opt out of this arbitration provision by sending written notice to hello@goji.pet within 30 days of creating your account.
You may terminate your account at any time through account settings. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance.
